Daycare Enrollment Discrimination

Texans for Vaccine Choice has been working on the issue of childcare facilities illegally denying vaccine exemptions for enrollment for several years. Even after HHSC issued this Operation Action Letter, admitting to a “previous misapplication of the statute” and agreeing that, by law, all licensed childcare centers in Texas must accept vaccine exemptions, TFVC continues to receive reports that some facilities continue to deny them. If, after ensuring the facility is licensed by searching this database and providing the licensed facility a motorized exemption affidavit and the Operation Action Letter, they persist in denying enrollment, please submit your story using the form below so that we may show HHSC how pervasive this problem continues to be.

Medicaid/CHIP Provider Discrimination

TFVC was successful in getting a significant Medicaid/CHIP reform measure passed. As of September 1, 2023, doctors who contract with Medicaid/CHIP are no longer allowed to refuse to see Medicaid/CHIP patients based on vaccination status. Unfortunately, TFVC continues to receive reports about violations of HB 44.

COVID Vaccine Employment Discrimination

With the passage and implementation of SB 7, private entities are prohibited from requiring the COVID vaccine for anyone performing work in exchange for a benefit (whether paid or unpaid). SB 7 protects everyone - from volunteers to interns to employees. Unfortunately, TFVC continues to receive reports about violations of SB 7. 

Formal Complaints: Texans need to contact the Texas Workforce Commission using THIS FORM if they feel they are being wrongfully denied employment, benefits or accommodations by an employer due to their COVID vaccination status. TWC is the state agency tasked with investigating complaints and enforcing the $50,000 fine against companies found to be in violation of the law.

Private School Enrollment Discrimation

Over the years, Texans for Vaccine Choice has received many messages from supporters about their disappointment in private schools not accepting vaccine exemptions. We have partnered with parents on an individual basis to help make headway on this issue, but would like to bring more awareness to the subject through a concentrated group effort. We invite you to complete the short survey below if this is a cause that is important to your family. Your privacy is important to us. Note: Texas private schools that do not receive any state funding are permitted to implement their own vaccine and exemption policies which means that at this time, this type of enrollment refusal is allowable. TFVC remains committed to protecting all Texans from vaccine-based discrimination, so your story could be helpful in our advocacy efforts.
