Last week, U.S. District Court Judge Brian E. Murphy granted the American Academy of Pediatrics’ (AAP) petition in their lawsuit against Secretary Robert F. Kennedy, Jr., issuing a preliminary injunction with major impacts. This ruling:
- Reinstates the prior, higher-dose CDC childhood vaccination schedule (reversing its January 2026 reduction from covering ~17 diseases to 11, aligning closer to international norms but now blocked).
- Stays all 2025 vaccine-related votes by the reconstituted ACIP, including downgrades to flu, COVID-19, hepatitis B, and other recommendations.
- Halts Secretary Kennedy’s appointments of the 13 new ACIP members, canceling last week’s critical meeting.
That meeting was set to hear from COVID-19 vaccine-injured patients and consider a new ICD code to officially track vaccine injuries.
Quick ACIP Primer: The Advisory Committee on Immunization Practices (ACIP) is the CDC’s expert panel guiding U.S. vaccine recommendations and insurance/public coverage. The HHS Secretary, currently RFK Jr., appoints members for their public health expertise.
But the AAP, a paid membership group, lobbied this judge to override that authority and stall MAHA progress. The government plans to appeal, and we’re watching closely.
Texas has won more medical liberty victories than most states through years of grassroots work, but complacency isn’t an option. The pharmaceutical industry and AAP will go to extreme lengths to protect profits, and overturning decades of overreach won’t happen quickly.
