Texans for Vaccine Choice took action weeks ago in anticipation that rogue school districts and colleges could incorrectly apply current state vaccine exemption law for next school year in light of the declared Covid-19 emergency. (See TAC 97.62 in State Rep James White’s letter pictured below.)
TFVC was concerned that the legislative intent of the law could be ignored by schools attempting to exclude students with exemptions for any vaccine because of the declared emergency, even though a vaccine relevant to the Covid-19 emergency does not yet exist. We have patiently waited for the Attorney General’s response & are grateful for Rep. White’s continued communication with us during this process.
We are sad to say that we now have evidence that this scenario is indeed happening at Kilgore College. While this Texas college threatens the medical rights of their students, the Attorney General has stayed silent.
Reach out to Attorney General Ken Paxton and ask him to immediately clarify the code before any more Texas schools attempt to remove the rights of their students by misapplying the law and going against its historical implementation.
Attorney General Paxton, an opinion request regarding vaccine exemption policy was submitted to your office on May 19, 2020 from the Office of Rep. James White. I kindly ask you to clarify this section of law as quickly as possible. TAC 97.62 has historically been applied very precisely and carefully, and I am concerned about my school misapplying the law during the declared Covid-19 emergency.
