A State District Judge in Wharton County has declared a HUGE VICTORY for vaccine choice!
In the summer of 2020, Texans for Vaccine Choice sounded the alarm on colleges using the declared Covid emergency to deny exemptions for shots UNRELATED to the emergency. Dr. Peter Osborne decided to take his son Kane’s case to the courts. TFVC was proud to support Dr. Osborne in bringing the lawsuit.
Today, TFVC is thrilled to announce that subsection (d-1) of the statute that allowed for this unscientific policy loophole has been declared UNCONSTITUTIONAL because it violates Article 1, Sections 3 and 6 of the Texas Constitution. The Court ruled that allowing for the suspension of philosophical and religious vaccine exemptions during an emergency violated equal protection and religious freedom, both guarantees of the Texas Bill of Rights.
This was an unequivocal victory that will immediately and directly influence college exemption policies across the state.
